Tawny Is The Coolest, LLC (“Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you share with us.

This Privacy Policy explains how we collect, use, store, and disclose personal information when you visit unlearnthebs.com or lifewithtawny.com (collectively, the “Websites”), subscribe to our emails, complete a Capacity Audit, purchase or participate in coaching services, or otherwise interact with us (collectively, the “Services”).

By using the Services or providing personal information to us, you acknowledge the practices described in this Privacy Policy.

INFORMATION WE COLLECT

The information we collect depends on how you interact with us.

Information You Provide to Us

We may collect information you voluntarily provide, including:

  • First and last name;

  • Email address;

  • Phone number, when voluntarily provided;

  • Information submitted when subscribing to an email list, downloading a free resource, or completing a form;

  • Scheduling and appointment information;

  • Communications you send to us by email, text message, Marco Polo, or other communication methods;

  • Information provided through Capacity Audits, onboarding forms, assessments, or coaching exercises;

  • Coaching notes, resources, exercises, and other materials created or shared as part of a coaching relationship;

  • Testimonials, reviews, feedback, photographs, audio, or video you voluntarily provide; and

  • Other information you voluntarily provide to us.

Paid Client Onboarding Information

Paid coaching clients may be asked to complete an onboarding form so that we can better understand their goals, circumstances, and needs.

Depending on the information you choose to provide, this may include information such as:

  • Age;

  • Income or income range;

  • Occupation or industry;

  • Personal or professional goals;

  • Challenges, priorities, or circumstances relevant to coaching; and

  • Other information you voluntarily provide about yourself.


We use this information to understand your goals and circumstances, personalize and provide coaching Services, and better understand the characteristics and needs of our client base and audience.

We may also use onboarding information in an aggregated or de-identified manner to understand our audience, identify general patterns or trends, evaluate our Services, and improve our business. When information is aggregated or de-identified for these purposes, we do not use it to publicly identify individual clients.

We do not sell paid-client onboarding information or provide it to third parties for their independent marketing purposes.

Capacity Audit Information

If you complete a Capacity Audit, we collect the information you provide through the assessment, including information about your experiences, behaviors, patterns, relationships, work, stressors, and other circumstances you choose to share.

Capacity Audit responses are collected for the purpose of reviewing your individual circumstances, preparing for your Capacity Audit, and providing coaching or related Services to you.

We do not use the substance of your Capacity Audit responses for email marketing or advertising.

Capacity Audit assessments are currently completed through Google Forms, and responses may be stored using Google Sheets. Accordingly, Google processes and stores this information on our behalf subject to its own privacy and security practices.

Access to Capacity Audit responses within our business is limited to Tawny Ann De La Peña, except where disclosure or processing is necessary to operate the Services, comply with law, protect legal rights, or as otherwise described in this Privacy Policy.

Payment Information

Payments for coaching and other paid Services are currently facilitated through Paperbell and processed by Stripe.

We do not directly collect or store your complete credit or debit card information. Payment processors may collect payment and transaction information necessary to complete your purchase in accordance with their own privacy policies and security practices.

Coaching Sessions, Recordings, Transcripts, and AI-Generated Summaries

Coaching sessions may take place through Zoom and may be recorded, transcribed, and summarized using Fathom, an AI-powered meeting assistant. Clients are informed when Fathom is being used and may ask for it to be turned off.

When Fathom is used, it may process information discussed during a coaching session, including information you voluntarily share about your experiences or circumstances, for the purpose of recording or transcribing the session and generating AI-powered summaries, notes, or other meeting-related content.

Recordings may be stored through pCloud and made available to the applicable client through their Paperbell client portal. AI-generated summaries, coaching notes, and related client materials may also be maintained through Google Drive or Google Docs and shared with the applicable client.

Access to client recordings, transcripts, summaries, and coaching materials within our business is limited to Tawny Ann De La Peña, except where access or processing by our service providers is necessary to provide the Services, maintain or secure our systems, comply with law, protect legal rights, or as otherwise described in this Privacy Policy.

AI-generated transcripts and summaries may contain errors and are used as tools to assist with documentation and coaching. They should not be considered verbatim or independently verified records of a session.

Availability of recordings, notes, summaries, resources, or other materials through a third-party client portal is dependent on the continued availability and functionality of that service. We do not guarantee permanent access to materials through Paperbell or any other third-party platform.

INFORMATION COLLECTED AUTOMATICALLY

When you visit our Websites or interact with our emails, certain information may be collected automatically by us or by service providers that help us operate the Services.

This may include:

  • IP address;

  • Browser and device information;

  • General information about how you interact with our Websites;

  • Pages or links you interact with;

  • Email delivery information;

  • Whether an email was opened; and

  • Links clicked within an email.

We currently use Flodesk to manage email subscriptions, email campaigns, and automated email workflows. Flodesk may collect information regarding your interaction with our emails, including opens and link clicks.

We may use email engagement information to understand how subscribers interact with our communications, organize or segment our email audience, determine which communications may be relevant to subscribers, and improve our emails and Services.

HOW WE USE PERSONAL INFORMATION

We may use personal information to:

  • Provide and administer our Services;

  • Schedule and conduct Capacity Audits and coaching sessions;

  • Review information you submit in preparation for providing Services;

  • Understand client goals, needs, and circumstances;

  • Personalize coaching Services;

  • Create and maintain client records;

  • Provide client resources, coaching notes, recordings, transcripts, summaries, and other materials;

  • Communicate with clients and prospective clients;

  • Respond to questions, requests, and support inquiries;

  • Process and administer purchases and payments;

  • Deliver requested resources or downloads;

  • Send newsletters, educational content, updates, promotional communications, and other marketing emails where permitted;

  • Understand engagement with our emails and communications;

  • Segment our email audience based on engagement;

  • Understand our client base and audience, including through aggregated or de-identified information;

  • Evaluate and improve our Services and business;

  • Maintain, operate, and improve our Websites;

  • Prevent fraud, misuse, or security incidents;

  • Maintain appropriate business and financial records;

  • Enforce our agreements and protect our legal rights; and

  • Comply with applicable laws and legal obligations.


We do not use the substance of your private Capacity Audit responses for email marketing or advertising.

EMAIL COMMUNICATIONS

If you subscribe to our email list, request a free resource, or otherwise sign up to receive communications from us, we may send you the requested content as well as newsletters, educational content, information about our Services, and promotional communications, as disclosed when you sign up and as permitted by applicable law.

Our email funnels may automatically transition subscribers into our general email newsletter after the initial email sequence is complete.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in our marketing emails.

Unsubscribing from marketing communications does not necessarily prevent us from sending non-marketing communications that are necessary to administer an existing client relationship, transaction, appointment, or other Service you have requested.

We periodically remove unsubscribed contacts from our email marketing system.

TESTIMONIALS, REVIEWS, AND CLIENT STORIES

We may invite clients to voluntarily provide testimonials, reviews, feedback, photographs, audio recordings, video recordings, or other information about their experiences with our Services.

With the client's permission, we may use or publish authorized testimonial materials for marketing, promotional, educational, or business purposes. Depending on the permission provided, this may include a client's name, image, likeness, voice, statements, experiences, or information about results they choose to share.

The specific information included and the ways it may be used will depend on the permission or authorization provided by the client.

We do not publish private Capacity Audit responses, coaching notes, or private coaching communications as testimonials without permission.

HOW WE DISCLOSE PERSONAL INFORMATION

We do not sell or rent our email list or personal information to third parties for their independent marketing purposes.

We may disclose personal information to third-party service providers when reasonably necessary to operate our business and provide the Services. These may include providers that assist us with:

  • Website hosting;

  • Email marketing and communications;

  • Forms and information collection;

  • Client portals and scheduling;

  • Video conferencing;

  • Session recording, transcription, and AI-generated meeting summaries;

  • Cloud storage and document management;

  • Payment processing; and

  • Client communications.


Our current service providers may include Hostinger, Flodesk, Google, Paperbell, Stripe, Zoom, Fathom, pCloud, and Marco Polo.

These companies may process personal information as necessary to provide their services to us and are subject to their own contractual obligations, privacy policies, and security practices.

We may also disclose information:

  • When required by law, subpoena, court order, or other valid legal process;

  • To protect our rights, property, safety, clients, users, or others;

  • To investigate fraud, security concerns, or violations of our agreements;

  • In connection with a merger, acquisition, sale, restructuring, financing, or transfer of some or all of our business or assets;

  • When you have authorized us to publicly use information as part of a testimonial, review, or similar promotional material; or

  • With your consent or at your direction.

COOKIES AND SIMILAR TECHNOLOGIES

Our Websites and the third-party services used to operate them may use cookies and similar technologies that are necessary for website functionality, security, performance, or basic analytics.

We do not currently use Google Analytics, advertising pixels, or similar technologies for behavioral or retargeted advertising on our Websites, and we do not currently use information collected through our Websites to serve targeted advertisements.

Third-party services integrated with or linked from our Websites may use their own cookies or similar technologies. Their use of those technologies is governed by their respective privacy policies.

You can control or delete cookies through your browser settings. Disabling certain cookies may affect the functionality of some portions of the Websites.

We take reasonable administrative, technical, and organizational measures designed to protect personal information from unauthorized access, disclosure, alteration, loss, or misuse.

For example, client information may be stored through password-protected or access-controlled third-party services, and access to private coaching, onboarding, and Capacity Audit information within our business is limited.

However, no method of transmitting information over the Internet or electronically storing information can be guaranteed to be completely secure. We therefore cannot guarantee the absolute security of personal information.

DATA RETENTION

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including providing Services, maintaining appropriate client and business records, making client materials available where applicable, satisfying legal, accounting, or reporting obligations, resolving disputes, and protecting or enforcing our rights.

Retention periods may vary depending on the type of information and the reason it was collected.

Client records, including onboarding information, coaching notes, Capacity Audit information, recordings, transcripts, and AI-generated session summaries, may be retained after a coaching relationship ends.

Clients may continue to have access to certain materials through third-party platforms while those platforms and our accounts with them remain available. Such access is not guaranteed indefinitely.

We may retain certain information even after a deletion request when reasonably necessary or legally required, including for tax, accounting, fraud prevention, dispute resolution, contractual, or other legitimate legal purposes.

LINKS AND THIRD-PARTY SERVICES

Our Websites, emails, client portals, and other communications may contain links to websites or services operated by third parties.

We are not responsible for the privacy practices, content, or security of third-party websites or services. When you interact directly with a third-party service, its privacy policy and terms may govern its collection and use of your information.

We encourage you to review the privacy practices of third-party services you choose to use.

Tawny Is The Coolest, LLC is a United States company organized in Oklahoma.

We and the service providers we use may process or store personal information in the United States or other countries.
